The processing of personal data is necessary to provide you with the services requested when agreeing to our Terms & Conditions or for the implementation of measures taken before the agreement to the contract by the online trader.

1. Identity and contact details of the organisation

• 1.3. The organisation has not appointed a data protection officer.

2. Legal reason for processing personal data

• 2.1. The legal reason for processing your personal data is the necessity for the fulfilment of the contract between you and the organisation, or for the implementation of measures by the organisation before concluding such a contract within the framework of Article 6 (1) (a). (b) Regulation 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (General Data Protection Regulation) ("the Regulation").

3. Purpose of personal data processing

• 3.1. The purpose of processing your personal data is to fulfil the terms & conditions between you and the organisation or to take measures by the organisation before concluding such a contract.
• 3.2. There is no automatic decision-making by the administrator within the meaning of Article 22 of the Regulation.

4. Time period for storage of personal data

• 4.1. The period for which your personal data will be stored by the administrator is 10 years.

5. Third parties are collecting personal information

• 5.1. Other recipients of your personal data will be courier companies and other persons involved in the delivery of goods or the implementation of payments based on the purchase contract.
• 5.2. The administrator does not intend to share your personal data to a third country (to a country outside the EU) or to an international organization.

6. Rights of the user

• 6.1. Under the conditions set out in the regulations, you have the right to request access to your personal data from the administrator, the right to correct or delete your personal data, or restrict their processing, the right to object to the processing of your personal data, and the right to the sharing of your personal data.
• 6.2. If you believe that the processing of your personal data has violated or is violating the regulation, you have, among other things, the right to file a complaint with the supervisory authority.
• 6.3. You are not obliged to provide your personal data. The provision of your personal data is a necessary requirement for the agreement and conduct of the contract and without the provision of your personal data, it is not possible to conclude the contract or fulfill it by the administrator.

7. Rules for handling the personal data of BITFORCE, s.r.o.

• 7.1. These rules for handling the personal data of Bitforce, sro, ID number: 03178927, with its registered office at Novákových 393/16, 180 00, Prague 8, Registered in the Commercial Register kept by the Municipal Court in Prague, Section C, Insert 227820 (hereinafter referred to as “Bitforce”) regulate the principles of processing personal data of visitors to the website www.kofio.cz (hereinafter referred to as "KOFIO"), especially their registered user (hereinafter referred to as "user") and Bitforce customers who place an order through the website (hereinafter referred to as "customer").
• 7.2. Bitforce acts as the administrator in the processing of personal data and thus determines for what purpose and by what means the personal data will be used.

8. Which personal data is collected

• 8.1. Data provided by customers. At Bitforce, we process personal data about users and customers. Primarily, the personal data that is used is that which is provided to us by the customer when registering at KOFIO or when creating an order
• 8.2. This information includes the e-mail address and, in the case of customers, also the name, address, telephone number and payment details. It is also up to customer discretion to provide additional information, such as company address or a note.
• 8.3. Data obtained through cookies. To better target advertising campaigns and improve the range of products and services, Bitforce uses information about the goods that our customers have purchased. If you have enabled the cookies in your browser and you agree to their use, Bitforce obtains data about visits to websites, viewed products and other activity on KOFIO.
• 8.4. Bitforce does not collect or otherwise process any sensitive personal data, including, for example, information about your health condition, religion or beliefs, etc.

9. Purpose of data collection

• 9.1. We use your name and contact details to process your order, i.e. to realize the contract between Bitforce and the customer. Data processing in this case includes all activities from the creation of an order, its processing, including payment and delivery of the ordered goods. If the data is not provided, Bitforce cannot process your order.
• 9.2. To inform our customers of products in the form of commercial messages, Bitforce primarily uses an email address, and occasionally a telephone number for sending SMS. In this case, we send commercial communications about products related to goods that you have already purchased on the website. Data is processed due to Bitforce's legitimate interests in limiting direct marketing. Bitforce does not require the consent to send these commercial communications, but allows you to unsubscribe from the newsletter at any time, or to object to such processing. Customers who register with KOFIO can be sent a business message on the basis of consent, which is completely voluntary and dissenting does not affect the completion of your order. You give your consent to Bitforce during registration at KOFIO or later in the settings of your user account. You can revoke your consent at any time by clicking on the appropriate link located in each business message or user account settings. If you withdraw your consent, we will no longer process your data for the purpose of sending commercial communications, even for the above-mentioned reason of realizing Bitforce's legitimate interests.
• 9.3. Bitforce primarily uses email as a method of communication to offer products and promote KOFIO in the form of commercial messages sent to users. In this case, processing takes place only on the basis of your consent, which is completely voluntary, and even if it is not granted, you can continue to make full use of our website. You give your consent to Bitforce during registration at KOFIO or later in the settings of your user account. Please note that only persons over the age of 15 can register for KOFIO. You can revoke your consent at any time by clicking on the appropriate link located in each business message or user account settings.
• 9.4. To increase the accuracy of advertising and promotion targeting, Bitforce processes data about visits to websites, viewed products and other activity on the website when using cookies. Processing is only possible on the basis of your consent to the use of the relevant cookies. Even this consent is completely voluntary. As a rule, based on the above data, Bitforce obtains statistics, analyzes and reports on the behavior of website users. Based on them, it is then possible to better target advertising or adapt the content of the website to what you are really interested in and what you are looking for, or what is generally of interest to a larger group of users. In this case, the processing of personal data is usually automated.
• 9.5. To ensure good customer support, we use your name and email information, which you fill in before starting a chat with a Bitforce employee in the appropriate chat window on the website. By filling in the data, you express your consent to the processing of the stated data. Your name and email address will not be used solely for the purpose of the chat only.

10. Withdrawal of consent and cancellation of sending commercial communications

Business message. KOFIO users and customers can unsubscribe from commercial communications at any time, as follows:
• by clicking on the appropriate link located at the foot of each business message (email); or
• raise an objection to the processing of personal data at Bitforce by sending an email to the address hello@kofio.co or through other contacts specified in these rules.
If you want to disable the storage of cookies on your device, you can change the settings directly in your browser. If you disable KOFIO cookies, some parts of the website may not work properly.

• 10.1. In accordance with the relevant provisions of Act No. 127/2005 Coll. on electronic communications, the visitor has the right to decide whether to allow "cookies" on his device through the settings of his browser. A visitor who has not changed the "cookies" setting on his computer agrees to the storage of "cookies" on his device.

11. Who has access to my data?

• 11.1. Primarily, all personal data is processed by Bitforce and its employees. All persons having access to personal data are bound by confidentiality and this obligation continues even after the end of their cooperation with Bitforce.
• 11.2. Bitforce also, as the administrator, entrusts the processing of personal data to other entities, such the handlers and delivery companies (order processors). These order processors are any entity that processes personal data for Bitforce for the purposes and in the manner specified by Bitforce. If your consent to the processing required, we only transfer the data to the processors if you have given your consent. We provide processors with only the data they need to provide their services. The processors that Bitforce uses include:
  • transport companies – Česká pošta, s.p., Zásilkovna s.r.o., Direct Parcel Distribution CZ s.r.o (DPD)
  • Google LLC (online marketing tools)
  • Facebook, Inc. (online marketing tools)
  • Seznam.cz, a.s. (online marketing tools)
  • Zendesk, Inc. (provision of customer support services)
  • Freshworks Inc (provision of customer support services)
  • Tidio LLC., Tidio Ltd., Tidio Poland Sp. Z o.o., Tidio Poland Sp. z o.o. Spółka Jawna (provision of customer support services)

12. How long is data processed?

• 12.1. Bitforce processes personal data for the purpose of fulfilling the contract for the entire period of processing the order, including its payment and delivery of goods. By law, Bitforce subsequently stores some of the data contained in the accounting documents.
• 12.2. Commercial messages are sent to users for the entire period that they continue to consent to their sending. In the case of customers, business messages are sent until their subscription is cancelled, or until an objection is raised against the processing of their data for this purpose. However, commercial communications are sent for a maximum of 10 years. Bitforce will then ask for new consent.

13. What are your rights?

• 13.1. In regards to the processing of personal data, you can contact Bitforce and request:
  • Information regarding the personal data that Bitforce processes, the purpose and nature of the processing of personal data, including information on potential recipients of personal data outside of Bitforce. General information on personal data processing activities is contained in these rules.
  • Access to the information you provide to Bitforce, whether during registration or order creation. If you exercise this right, Bitforce will confirm whether and what specific personal data is being processed/stored and, if so, this data will be made available to you together with information about their processing.
  • Correction of personal data if they are inaccurate or incomplete in any way. Only in the case of current data can Bitforce process your order correctly.
  • Explaining and removing wrongful information (e.g. blocking, correcting, supplementing or disposing of personal data) if you believe that Bitforce is processing personal data in violation of the protection of your personal and private life or in violation of the law.
  • Deletion of personal data (so-called right to be forgotten) or their limited processing, if they are no longer needed for the stated purposes, or if Bitforce no longer has a legal reason to process personal data, including cases where you do not agree with their further processing. Upon meeting the above conditions, Bitforce will completely or partially destroy your data.
  • Transfer of automatically processed personal data obtained on the basis of your consent from Bitforce to another entity, where Bitforce transfers your personal data in a commonly used format to you or another administrator at your request.
• 13.2. Additionally, Bitforce customers may object to the processing of personal data in the event of sending business messages or evaluating purchase preferences, on the basis of which Bitforce will immediately terminate the processing of personal data for these purposes.
• 13.3. In addition to the above rights, you can always complain to the Office for Personal Data Protection in the event of a breach of Bitforce's obligations.

14. Security

• 14.1. Bitforce takes care of the security of your data. The handling of personal data is carried out in full compliance with applicable legislation, including the General Data Protection Regulation (GDPR). When processing personal data, Bitforce places great emphasis on the technical and organizational security of the processed data.
• 14.2. All personal data in electronic form are stored in databases and systems to which only persons who need to handle personal data directly for the purposes set out in these rules have access, and only to the extent necessary. Access to this personal data is protected by a password and firewall. The security of personal data is regularly tested by Bitforce and we are constantly improving our protection.
